The Toronto Label
Article 1 – Definitions
In these Terms and Conditions, the following definitions apply:

Cooling-off period: the period within which the consumer may exercise the right of withdrawal (30 days).

Consumer: the natural person who is not acting in the course of a business or profession and who enters into a distance contract with The Toronto Label.

Day: calendar day.

Durable medium: any tool that allows the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction.

Right of withdrawal: the possibility for the consumer to cancel the distance contract within the 30-day cooling-off period.

Entrepreneur: The Toronto Label, which offers products and/or services to consumers at a distance.

Distance contract: a contract concluded within the framework of an organized system for distance sales of products and/or services, where exclusive use is made of one or more technologies for distance communication.

Terms and Conditions: these Terms and Conditions of The Toronto Label.

Article 3 – Applicability
These Terms and Conditions apply to every offer made by The Toronto Label and to every distance contract concluded between The Toronto Label and the consumer.
Before the distance contract is concluded, the text of these Terms and Conditions will be made available to the consumer. If this is not reasonably possible, The Toronto Label will indicate, before the contract is concluded, how the Terms and Conditions can be reviewed electronically and that they will be provided free of charge upon request.
Situations not covered by these Terms and Conditions will be interpreted in line with their spirit and intent.
Article 4 – The Offer

If an offer has a limited validity period, this will be clearly stated.

The offer is non-binding. The Toronto Label reserves the right to adjust or withdraw offers.

The description of the products is as accurate as possible. Images are intended as a truthful representation but may differ slightly from the actual product (e.g., colors may vary).

Each offer contains clear information on:

The total price (excluding applicable duties, import taxes, and customs fees for non-Canadian customers).
-
Delivery costs (if applicable).
-
The manner in which the contract will be concluded.
-
Whether the right of withdrawal applies.
-
Payment, delivery, and performance details.
-
The validity period of the offer and/or guarantee of the price.
-
The right to correct errors before placing the order.

Article 5 – The Agreement

The agreement is established at the moment the consumer accepts the offer and meets the stated conditions.

After acceptance of an order, The Toronto Label will send an electronic confirmation. Until receipt of confirmation, the consumer may cancel the order.

The Toronto Label will take reasonable technical and organizational measures to secure electronic transactions and the online environment.

The Toronto Label reserves the right to refuse an order if there are reasonable grounds (e.g., non-payment history, fraud risk).
Article 6 – Right of Withdrawal

Consumers have the right to cancel their purchase within 30 days of receiving the product, without providing a reason.

During the cooling-off period, consumers must handle the product and packaging with care. They may inspect the product as they would in a physical store.

To exercise the right of withdrawal, consumers must notify The Toronto Label by email (info@thetorontolabel.com) within the 30-day period.

Consumers must return the product within 30 days after notifying The Toronto Label. The product should, where reasonably possible, be returned in its original condition and packaging.

Proof of timely return (such as a Canada Post or courier tracking receipt) is the responsibility of the consumer.
Article 7 – Costs in Case of Withdrawal

Return shipping costs are the responsibility of the consumer.

Once the returned product has been received, The Toronto Label will refund the full purchase price (excluding original shipping costs) within 30 days.
Article 8 – Exclusion of Right of Withdrawal
The right of withdrawal does not apply to products that are:

Made to the consumer’s specifications or personalized.
-
Of a hygienic nature and have been unsealed (e.g., skincare, underwear).
-
Perishable or time-sensitive.
-
Digital products that have already been accessed/downloaded.
Article 9 – Prices

Prices are listed in Canadian dollars (CAD) and include applicable GST/HST for Canadian customers.

For international customers, additional duties, customs fees, and import taxes may apply, which are the responsibility of the consumer.

The Toronto Label is not responsible for misprints or typographical errors.
Article 10 – Conformity and Warranty

The Toronto Label guarantees that products conform to the contract, the stated specifications, and are fit for normal use.

Warranty claims must be reported within 30 days after delivery.

Warranty does not apply if:

The product has been altered, misused, or damaged by the consumer.
-
Normal wear and tear occurs.
-
The product was damaged due to circumstances beyond The Toronto Label’s control.

Article 11 – Delivery and Performance

The Toronto Label will take the utmost care when receiving and fulfilling orders.

Orders will be delivered to the address provided by the consumer.
-
Delivery will take place within a reasonable timeframe, typically within 30 days, unless otherwise agreed. If a delay occurs, the consumer will be informed promptly.

The risk of damage and/or loss of products rests with The Toronto Label until delivery to the consumer.
Article 12 – Duration Contracts
For contracts involving recurring deliveries or subscriptions:

Consumers may cancel at any time with a maximum notice period of one month.

Subscriptions will not be automatically renewed without the consumer’s explicit consent.
Article 13 – Payment

Payments must be made in accordance with the payment methods provided at checkout.

Consumers are responsible for ensuring payment information is correct.

In case of non-payment, The Toronto Label reserves the right to recover reasonable collection costs within the limits of Canadian law.
Article 14 – Complaints Procedure

Complaints regarding execution of the contract must be submitted within 7 days after defects are discovered, via info@thetorontolabel.com.

Complaints will be handled within 30 days. If a longer processing time is needed, consumers will be informed of the expected timeline.

Filing a complaint does not suspend the consumer’s payment obligation.
Article 15 – Disputes

These Terms and Conditions are governed by the laws of Canada.

In case of a dispute, Canadian federal courts will have jurisdiction.
